Consequences of Domestic Violence Charges
Edward N. Ajlouny
San Jose Domestic Violence Defense Lawyer
The consequences of domestic violence charges, including child abuse and elder abuse, can be significant. At a minimum, a person is required to participate in and pay for a 52-week batterer intervention program if convicted under:
- California Penal Code Section 243(e) for domestic battery
- California Penal Code Section 273.5 for felony domestic violence
- California Penal Code Section 273.6 for violating a protective restraining order
- Or other charges where domestic violence is the underlying factual scenario
However, oftentimes I am able, through hard work, to obtain the 16-week class or the 20-hour anger management class instead. For non-U.S. citizens, convictions for domestic violence, including child abuse and elder abuse, can affect their immigration status and naturalization process.
A Skilled Advocate
Anyone facing charges for child abuse, elder abuse, or other domestic violence in California-including violation of an emergency protective order or no-contact order-should seek a knowledgeable and skilled defense attorney to protect and defend their rights.
I have many years of experience in handling these types of cases, and I am very skilled at it. Nearly half my practice is devoted to fighting for people charged with domestic violence crimes.
I understand the options and know how to prepare and defend a case. For example, I have been able to reduce the 52-week domestic violence classes to 32-week anger management classes. I have also arranged to have criminal records expunged for my clients.
Serious Consequences
The consequences of more serious offenses may include jail or prison time, formal probation, and the denial of the right to possess a firearm for ten years.
A conviction can have an impact on a person's livelihood because employers in California consider domestic violence to be very serious. I know of many high-tech workers who discovered that it was difficult to find new employment because they had criminal records for domestic violence.
