Dismissal and Expungement of Domestic Violence Charges
Edward N. Ajlouny
San Jose Domestic Violence Defense Lawyer
If you are facing charges or have been convicted of felony or misdemeanor domestic violence, your criminal record can become a serious obstacle to obtaining many important things in the future, including employment, housing, and credit. For non-U.S. citizens, a domestic violence conviction can affect immigration status and even halt the naturalization process.
Under California Penal Code Section 1203.4, many convictions can be expunged once a person has successfully completed the sentence and probation. Expungement does not totally clear a conviction from a person's record. However, under California law it does allow a person to legally say that he or she has not been convicted of the crime.
Hardworking, Persistent, and Successful
I work very hard for my clients when negotiating to get their charges dismissed or their records expunged.
- I interview my client face-to-face.
- I interview the alleged victim when possible. Often, the alleged victim will ask if the charges can be dropped. The answer is no. The alleged victim, however, may write a statement and we can talk about what it should say.
- I review the police report and analyze the case in detail. If the report is inaccurate, the alleged victim can write a statement explaining what really happened.
- I investigate to determine whether any injuries match the description of the alleged attack.
- I discuss the case with the district attorney and judge in a series of pretrial conferences.
- I move to have the charges dismissed, depending on the facts of the case.
- I move to have the charges reduced from felony to misdemeanor, depending on the facts of the case.
- I rarely accept the first or second offer from the district attorney.
- I advise my client that going to trial should be considered if I believe the evidence is weak.
- I usually get a better offer from the district attorney as we move along.
- I do not hesitate to go to trial if that seems to be the best course of action. I am a very good trial attorney.
- My goal is to obtain the best possible resolution for my client based on the facts of the case.
Expungement and dismissal can be complex and time consuming. Working with an experienced attorney, therefore, is of utmost importance. After all, it is your future that is at stake.

I file the paperwork and the motions with the court. I communicate with the probation department, which then makes a recommendation to the judge. I am persistent: If necessary, I make multiple applications for expungement on behalf of my client.
