If You Have Been Harassed at Work
First, try using the channels within your own workplace. By now, most companies have policies in place to deal with behavior like physical contact or offensive sexual remarks.
Once an incident occurs, report that incident the appropriate Human Resources or compliance officer right away. If the employer acts swiftly, you may not need to bring a lawsuit at all. If the employer ignores your request or drags its feet, your reporting will preserve your rights under the law and increase your credibility.
Often, the employer will take steps to correct the situation. If the employer disciplines the harasser, that may be an affirmative defense against a sexual harassment claim. If the employer can show that they took steps to correct the situation, it lessens the award or settlement that a lawsuit can bring.
